These Terms of Service ("Terms") govern your use of the Reservista platform and the Megon website, operated by Megon ("Megon," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using Reservista, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you are using Reservista on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
Reservista is a cloud-based hotel management platform that includes:
- Property Management System (PMS): Reservations, front desk operations, housekeeping management, guest profiles, night audit, and reporting
- Point of Sale (PoS): Restaurant and bar billing, inventory management, kitchen order tracking, and folio integration with the PMS
We may update, modify, or add features to the platform from time to time. We will provide reasonable notice of any changes that materially affect your use of the service.
3. Account Registration
To use Reservista, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information about yourself and your property
- Maintain one account per property unless otherwise agreed upon in writing
- Keep your login credentials confidential and not share them with unauthorized individuals
- Accept responsibility for all activity that occurs under your account
- Notify us immediately if you suspect unauthorized access to your account
4. Acceptable Use
You agree to use Reservista only for its intended purpose of managing hotel and hospitality operations. You may not:
- Use the service for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to discover the source code of the platform
- Share your account credentials with third parties or allow unauthorized users to access the platform
- Interfere with or disrupt the integrity or performance of the service
- Use automated scripts, bots, or scrapers to access or extract data from the platform without our written consent
5. Payment Terms
Reservista is offered as a subscription service. The following payment terms apply:
- All prices are listed in Indian Rupees (INR) and are exclusive of applicable taxes unless stated otherwise
- Subscription billing occurs on a monthly or annual basis, depending on your chosen plan
- New accounts are eligible for a 14-day free trial with full access to all features
- After the trial period, your chosen payment method will be charged automatically unless you cancel before the trial ends
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing cycle, and no refunds will be issued for partial periods
- We reserve the right to modify our pricing with at least 30 days written notice
6. Data Ownership
Your data belongs to you. Specifically:
- All hotel operational data, guest records, financial data, and other information you input into Reservista remains your property
- We do not sell, rent, or share your hotel data with third parties for marketing or commercial purposes
- You may request an export of your data at any time in a commonly used format
- We may use anonymized, aggregated data for analytics and product improvement purposes, but this data will never be traceable to your property or guests
7. Service Availability
We strive to maintain 99.9% uptime for the Reservista platform. However, the service may be temporarily unavailable due to:
- Scheduled maintenance, for which we will provide at least 24 hours advance notice via email or in-app notification
- Emergency maintenance required to address critical security issues or system failures
- Circumstances beyond our reasonable control, including internet outages, natural disasters, or force majeure events
We will make commercially reasonable efforts to minimize downtime and will communicate promptly during any service disruptions.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- Megon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, revenue, or business opportunities
- Our total cumulative liability for all claims arising from or related to these Terms or the use of Reservista shall not exceed the amount you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim
- The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose
9. Termination
Either party may terminate this agreement under the following conditions:
- You may cancel your subscription and terminate your account at any time by providing 30 days written notice
- We may terminate or suspend your account with 30 days notice if you breach these Terms, fail to pay fees, or for any other reasonable cause
- We may terminate your account immediately if you engage in activity that threatens the security or integrity of the platform
Upon termination, we will provide you with a reasonable window (at least 30 days) to export your data. After this period, your data will be permanently deleted from our systems.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or your use of Reservista shall be subject to the exclusive jurisdiction of the courts located in Guwahati, Assam, India.
